Gwinnett County Car Accident Lawyer

Help After a Car Accident in Gwinnett County

Gwinnett County stretches from Norcross out past Lawrenceville and Dacula, and most of it is tied together by a handful of busy highways and commercial corridors. A crash on any of them can leave you with medical bills, missed work and an insurance company that wants a recorded statement before you know the full extent of your injuries.

Hoffspiegel Law represents people injured in car accidents throughout Gwinnett County. Our office is at 2900 Chamblee Tucker Road in Atlanta. This page focuses on passenger-vehicle crashes in the county; our Gwinnett County truck accident lawyer page covers crashes with commercial trucks, and our Lawrenceville car accident lawyer page focuses on the county seat. For an overview of everything we handle in the county, see our Gwinnett County personal injury lawyer page, and for more on car crash claims in general, see our Atlanta car accident lawyer page.

Where Car Accidents Happen in Gwinnett County

  • I-85. The interstate runs through Norcross, Duluth, Lawrenceville, Suwanee and Buford, with interchanges at GA-316 and at I-985 near Suwanee.
  • I-85 Express Lanes. About 15 miles of I-85 Express Lanes run from Chamblee Tucker Road, just south of I-285, to Old Peachtree Road.
  • GA-316. State Route 316 begins at I-85 exit 106 west of Lawrenceville and heads east through Lawrenceville and Dacula toward Athens, sharing the roadway with US-29 for much of the way.
  • US-78. The Stone Mountain Freeway ends at the West Park Place Boulevard interchange in Mountain Park, and US-78 continues as a surface road through Snellville, where it meets SR 124.
  • Jimmy Carter Boulevard, Peachtree Industrial Boulevard and Buford Highway. These state routes carry heavy local traffic in the Norcross area. In 2025, the Gateway85 Community Improvement District announced a project with Gwinnett County, GDOT and the cities of Norcross and Peachtree Corners to add lanes at the intersection of Jimmy Carter Boulevard and Buford Highway, citing above-average crash and injury rates in the area. More than 57,000 drivers use that corridor each day.

How to Get a Gwinnett County Crash Report

The agency that responded to your crash is the one that holds the report. For crashes worked by the Gwinnett County Police Department:

  • Request a copy online through BuyCrash (buycrash.com). People involved in the crash and their authorized legal or insurance representatives can use it, and there is a charge.
  • Pick up a copy in person for $5 at police headquarters, 770 Hi Hope Road in Lawrenceville, or at any of the six precincts (Bay Creek, Central, East, North, South and West), Monday through Friday.
  • Reports are typically ready about four business days after the crash. You can check status by calling 770-513-5000.

If a city police department responded because the crash happened inside city limits, request the report from that department. If the Georgia State Patrol investigated, you can contact the local State Patrol post or the Department of Public Safety Open Records Unit.

Georgia Insurance Rules and Notice Deadlines for Gwinnett Crashes

Georgia is an at-fault state. The driver who caused the crash, and that driver’s liability insurer, are responsible for the harm. Georgia’s minimum liability limits are $25,000 per person, $50,000 per accident for bodily injury, and $25,000 for property damage. Those limits are often too low to cover a serious injury, which is why your own uninsured/underinsured motorist coverage under O.C.G.A. § 33-7-11 can matter as much as the other driver’s policy.

The Hands-Free Georgia Act, O.C.G.A. § 40-6-241, bars drivers from holding a phone while driving, and phone records are often part of the evidence in a crash claim. Our distracted driving accident page covers how phone records come into play. Crashes that involve an impaired driver or a driver who leaves the scene raise their own questions; see our pages on drunk driving accidents and hit-and-run accidents.

If a county vehicle was involved, such as a Gwinnett County work truck, Georgia law requires written ante litem notice to the county within 12 months (O.C.G.A. § 36-11-1). For a city vehicle, notice is due within 6 months (O.C.G.A. § 36-33-5), and for a state vehicle, within 12 months (O.C.G.A. § 50-21-26). Missing these deadlines can end a claim before it starts.

Where a Gwinnett County Car Accident Case Is Filed

Most car accident lawsuits in Georgia are filed in either State Court or Superior Court, depending on the defendants and venue rules. In Gwinnett County, both the State Court and the Superior Court sit at the Gwinnett Justice and Administration Center (GJAC), 75 Langley Drive in Lawrenceville. Depending on where the at-fault driver lives, a crash in Gwinnett could also lead to a case in another county.

Evidence to Preserve After a Gwinnett Crash

  • Photos of the vehicles, the road, skid marks, debris and any signals or signs at the scene
  • Names and phone numbers of witnesses before they leave
  • The report number from the responding officer
  • Dashcam footage, and the location of nearby businesses that may have cameras facing the road (footage is often overwritten within days)
  • All medical records, bills and receipts, starting with the first visit
  • Pay stubs or employer letters showing time missed from work
  • A simple daily journal of pain, sleep and activities you can no longer do

Damages in a Gwinnett Car Accident Claim

An injured person can seek compensation for medical expenses (past and future), lost wages and reduced earning ability, vehicle damage, and pain and suffering. When a crash takes a life, Georgia law allows certain family members to bring a wrongful death claim.

Filing Deadlines and Comparative Fault for Gwinnett Claims

Most Georgia personal injury claims must be filed within two years of the crash under O.C.G.A. § 9-3-33. Exceptions can apply, and claims against government bodies carry the shorter notice deadlines above, so it is worth getting answers early.

Georgia also uses modified comparative negligence under O.C.G.A. § 51-12-33. If you are found partly at fault, your recovery is reduced by your percentage of fault, and if you are 50 percent or more at fault, you recover nothing. Insurers often argue the injured driver was speeding, following too closely or distracted, so early evidence matters.

If you're a personal injury attorney looking for real, honest feedback about your case, do yourself a favor and schedule a focus group with Alex Hoffspiegel. I have had the pleasure of working with Alex on multiple focus groups, and each time the experience was invaluable. Sure, you'll receive feedback that validates obvious strengths of your case, but you're also likely to receive feedback that you never thought about (and don't like). Sometimes, the truth hurts, but it is best to hear it from 12 focus group members before you step in front of 12 strangers in a jury box, when there are no second chances or do-overs.

My husband and I were involved in an accident where I suffered a pretty intense concussion and some lingering pain. Alex and the entire staff at Hoffspiegal made sure I not only got the care that I needed but helped us navigate the complex legal process (especially when dealing with brain injuries!). We always felt like we could call with any sort of question or concern and that everyone felt like our family! The team truly kept us updated and helped explain every single aspect going on. We are so thankful for Alex and the amazing team he has for helping us through one of the hardest moments of our lives and making it simple and easy.

I’ve had the opportunity to consult with Alex Hoffspiegel on personal injury cases, and I’ve always been impressed by his ability to pick up on the details that matter and read a room exceptionally well. Those are qualities that make a real difference in this profession, particularly when dealing with clients, witnesses, opposing counsel, and juries. Just as importantly, Alex is a genuinely good human being. He relates naturally to people, communicates well, and brings both judgment and empathy to his work. I would not hesitate to recommend Alex to someone looking for an experienced and thoughtful personal injury attorney.

From the first conversation with Alex, I knew he was going to work for me. He answered all questions I had. Ms. Sabrina coached me through the entire process. The both (Alex and Sabrina)of them made me feel as part of a family that looked out for each other. Thank you both for being there for me when I was lost and needed legal guidance.

I was involved in an out of state car accident in Georgia. I was referred to Alex's firm through a Delaware attorney. Alex accepted our case. There were multiple moving parts to this case involving 3 different insurance companies from 3 different states. A lot of laws differed from Georgia laws that Alex normally dealt with. Alex and his team were amazing to work with. Alex familiarized himself with whatever he needed to in order to become knowledgeable about the laws of the states involved. He always made me feel like I was a priority at all times. My case ended up taking over 1.5 years to settle due to insurance companies dragging their feet. During this time, it was like talking to a friend when I would have calls with Alex. He would ask about my family and how things were going. He is very genuine and caring. Alex pushed for me to get a fair settlement. It was a pleasure working with Alex and his team! I would recommend Hoffspiegel Law to anyone looking for a good attorney that treats you like friend and not like a number.
