Dunwoody Truck Accident Lawyer

Why Tractor-Trailers Pass Through Dunwoody

Dunwoody is better known for its neighborhoods and Perimeter Center offices than for freight. But its southern border is I-285, and heavy trucks traveling through Atlanta, but not into the city, are required to bypass it on I-285. That routes long-haul tractor-trailers along Dunwoody’s edge every day. Add the delivery trucks that serve Perimeter Mall and the surrounding office towers, and trucks are a regular part of Dunwoody traffic.

Hoffspiegel Law represents people hurt in truck accidents in Dunwoody and across DeKalb County from our office at 2900 Chamblee Tucker Road in Atlanta. Our DeKalb County truck accident lawyer page covers truck crashes elsewhere in the county, and our Dunwoody personal injury lawyer page covers the other injury cases we handle in the city. For a fuller look at large-truck claims, see our Atlanta truck accident lawyer page. If your crash involved only passenger vehicles, our Dunwoody car accident lawyer page applies.

The Top End, GA-400 and Perimeter Deliveries

I-285 Exits 29 and 30

The section of I-285 between I-75 and I-85, called the Top End Perimeter, widens to 10 to 14 lanes in places and is one of the busiest freeways in the country. Dunwoody has two interchanges on it: exit 29 at Ashford-Dunwoody Road, a diverging diamond, and exit 30 at Chamblee-Dunwoody Road, North Shallowford Road and North Peachtree Road. A few miles east, I-285 meets I-85 at Spaghetti Junction. Trucks are barred from the far-left one or two lanes of I-285 except where left exits allow them, which means cars headed for an exit often have to cross lanes occupied by trucks.

GA-400 Truck Limits and Express Lane Work

Atlanta’s well-signed ban on through-truck traffic inside the Perimeter covers several major routes, including GA-400, which keeps through freight on I-285. GA-400 runs just west of Dunwoody in Sandy Springs. Local delivery trucks still use it, and the North Springs MARTA ramp off GA-400 (exit 5C) is closed to commercial vehicles. Heavy construction on GDOT’s SR 400 Express Lanes project began in April 2026. The project runs about 16 miles from the North Springs MARTA station to McFarland Parkway, and GDOT, which reports work under way at multiple locations in the corridor, expects the lanes to open in 2031.

Loading Docks Around Perimeter Mall

Perimeter Center, the edge city around Perimeter Mall, depends on box trucks and tractor-trailers for retail and office deliveries. Trucks turning into loading docks, backing up in tight spaces and making wide right turns near crosswalks put pedestrians, cyclists and smaller vehicles at risk.

Trucking Regulations and Defendants in a Dunwoody Case

Hours, Qualifications and Maintenance

Commercial motor carriers in interstate commerce must comply with the Federal Motor Carrier Safety Regulations, 49 C.F.R. Parts 390–399. Part 391 addresses driver qualifications, Part 395 sets hours-of-service limits, and Part 396 covers inspection and maintenance. A truck crash investigation looks at whether the carrier and driver followed these rules. A fatigued driver over the hours limit, or a truck with defective brakes, can be key evidence of fault.

Carriers, Shippers and the Insurer

A truck claim may involve the driver, the motor carrier, the truck or trailer owner, the shipper or loader, or a maintenance company. Georgia law can allow the trucking company’s insurer to be named directly (O.C.G.A. § 40-1-112 and § 40-2-140).

Government Trucks and Road Contractors

If a truck owned by a city, a county or the state caused the crash, written ante litem notice is required before filing suit: 6 months for a city such as Dunwoody (O.C.G.A. § 36-33-5), and 12 months for DeKalb County (O.C.G.A. § 36-11-1) or the state (O.C.G.A. § 50-21-26). A private contractor working on a public road project is a different kind of defendant, and identifying exactly who owned and operated a construction vehicle is an early step.

Carrier Data to Lock Down Early

The trucking company controls the records that often decide these cases. A preservation letter should go out early and ask for:

  • ECM and event data recorder downloads.
  • ELD hours-of-service logs and supporting documents.
  • The driver qualification file and drug and alcohol testing records.
  • Inspection and maintenance records.
  • Dispatch messages, delivery schedules and GPS data.
  • Dashcam and in-cab video.

If you can do so safely, photograph the truck, its markings and USDOT number, and the work zone or lane configuration, and get witness contact information.

Dunwoody Police and State Patrol Truck Crash Reports

For a crash inside Dunwoody, the Dunwoody Police Department, at 4800 Ashford Dunwoody Road, Suite 239, writes the report. The city accepts requests for crash reports online through its Police Reports and Open Records page or in person at City Hall, Monday through Friday, 8:00 a.m. to 5:00 p.m., and responds within three business days. The Records Clerk can be reached at 678-382-6700. If a different agency, such as the Georgia State Patrol, worked a crash on I-285, request the report from that agency; the Department of Public Safety handles State Patrol reports through the local post or its Open Records Unit.

Choosing the Court for a Dunwoody Truck Lawsuit

Dunwoody is in DeKalb County, whose Superior Court and State Court are both in the DeKalb County Courthouse at 556 North McDonough Street in Decatur. A truck case from a Dunwoody crash may be filed there. Crashes near the GA-400 interchange can happen in Sandy Springs, which is in Fulton County, and trucking companies are often based elsewhere, so venue needs careful review.

Catastrophic Truck Injuries and What Can Be Recovered

Large trucks can cause catastrophic harm, including spinal cord injuries, traumatic brain injuries, fractures and internal injuries. The Georgia Department of Public Health’s designated trauma center list includes Grady Memorial Hospital in Atlanta as a Level I center and Wellstar North Fulton Hospital in Roswell as a Level II center. Damages may include medical costs, future treatment, lost wages and earning capacity, pain and suffering, and property damage. If a truck crash took a loved one’s life, the family may have a wrongful death claim. Cyclists struck by trucks can read more on our bicycle accident page.

Time Limits After a Dunwoody Truck Crash

Georgia generally gives injured people two years from the crash to file suit (O.C.G.A. § 9-3-33). Exceptions can apply. Your damages can be reduced by your share of fault, and recovery is barred at 50% or more (O.C.G.A. § 51-12-33). Because trucking companies hold the data and some records are kept only for limited periods, it helps to act quickly.

If you're a personal injury attorney looking for real, honest feedback about your case, do yourself a favor and schedule a focus group with Alex Hoffspiegel. I have had the pleasure of working with Alex on multiple focus groups, and each time the experience was invaluable. Sure, you'll receive feedback that validates obvious strengths of your case, but you're also likely to receive feedback that you never thought about (and don't like). Sometimes, the truth hurts, but it is best to hear it from 12 focus group members before you step in front of 12 strangers in a jury box, when there are no second chances or do-overs.

My husband and I were involved in an accident where I suffered a pretty intense concussion and some lingering pain. Alex and the entire staff at Hoffspiegal made sure I not only got the care that I needed but helped us navigate the complex legal process (especially when dealing with brain injuries!). We always felt like we could call with any sort of question or concern and that everyone felt like our family! The team truly kept us updated and helped explain every single aspect going on. We are so thankful for Alex and the amazing team he has for helping us through one of the hardest moments of our lives and making it simple and easy.

I’ve had the opportunity to consult with Alex Hoffspiegel on personal injury cases, and I’ve always been impressed by his ability to pick up on the details that matter and read a room exceptionally well. Those are qualities that make a real difference in this profession, particularly when dealing with clients, witnesses, opposing counsel, and juries. Just as importantly, Alex is a genuinely good human being. He relates naturally to people, communicates well, and brings both judgment and empathy to his work. I would not hesitate to recommend Alex to someone looking for an experienced and thoughtful personal injury attorney.

From the first conversation with Alex, I knew he was going to work for me. He answered all questions I had. Ms. Sabrina coached me through the entire process. The both (Alex and Sabrina)of them made me feel as part of a family that looked out for each other. Thank you both for being there for me when I was lost and needed legal guidance.

I was involved in an out of state car accident in Georgia. I was referred to Alex's firm through a Delaware attorney. Alex accepted our case. There were multiple moving parts to this case involving 3 different insurance companies from 3 different states. A lot of laws differed from Georgia laws that Alex normally dealt with. Alex and his team were amazing to work with. Alex familiarized himself with whatever he needed to in order to become knowledgeable about the laws of the states involved. He always made me feel like I was a priority at all times. My case ended up taking over 1.5 years to settle due to insurance companies dragging their feet. During this time, it was like talking to a friend when I would have calls with Alex. He would ask about my family and how things were going. He is very genuine and caring. Alex pushed for me to get a fair settlement. It was a pleasure working with Alex and his team! I would recommend Hoffspiegel Law to anyone looking for a good attorney that treats you like friend and not like a number.
