Injury Help for McDonough and Henry County
McDonough is the county seat of Henry County, built around a traditional town square that still anchors the city’s historic district. It is also a crossroads. Interstate 75 runs through the southwestern part of the city, and a cluster of state routes meets nearby, so local errands, long-distance travel and freight all funnel through the same interchanges.
Hoffspiegel Law helps people injured in McDonough and across Henry County. We are based in Atlanta, at 2900 Chamblee Tucker Road, and that is our only office; we serve Henry County clients from there by phone, video and in-person meetings. For more about the county as a whole, see our Henry County personal injury lawyer page. We also represent people in Stockbridge, Jonesboro and Conyers.
I-75 Interchanges and the SR 155 Corridor
Interstate 75 serves McDonough through Exits 216, 218 and 221. The southern end of the South Metro Express Lanes, the tolled lanes in the I-75 median, sits in McDonough near the junction with State Routes 20, 81 and 155. U.S. 23 runs through the center of the city toward Stockbridge and Locust Grove, and State Routes 20, 42, 81, 155, 351, 401 and 920 all serve the area.
State Route 155 shows the strain. In September 2026, a crash involving a garbage truck caused major delays on Highway 155 near Old Griffin Road, east of I-75. That same month, WSB-TV reported that the Georgia Department of Transportation was holding public meetings on its plan to widen SR 155 for about 3.75 miles, from Hampton Locust Grove Road to I-75. According to the City of McDonough, the project is meant to reduce crashes, ease congestion and make it easier for pedestrians to get around.
Accidents and Injuries We See From McDonough
Interchange and Intersection Crashes
Interchange merges on I-75, rear-end crashes in backups on SR 155 and intersection wrecks around the square are common sources of injury claims. Because Georgia is an at-fault state, the responsible driver’s liability insurance is the first source of payment, but Georgia’s minimum limits are only 25/50/25. Our car accident lawyer page explains the process.
Garbage Trucks, Tractor-Trailers and Other Commercial Vehicles
Tractor-trailers travel I-75 through McDonough, and commercial vehicles of all kinds use the local state routes; the September 2026 SR 155 crash involved a garbage truck. Commercial truck drivers and carriers must follow federal rules on driver qualifications (49 C.F.R. Part 391), hours of service (Part 395) and vehicle inspection and maintenance (Part 396). Georgia law can allow the trucking company’s insurer to be named directly (O.C.G.A. §§ 40-1-112 and 40-2-140). Learn more about truck accident claims.
Motorcyclists at McDonough Intersections
Drivers who misjudge a motorcycle’s speed at an intersection or fail to check a blind spot can cause devastating injuries, and riders are more likely to face arguments that they share the blame. See our motorcycle accident lawyer page.
People on Foot or on Bikes
The City of McDonough lists easier pedestrian travel as one goal of the SR 155 widening, and walking along busy state routes carries real risk. Walkers and cyclists struck by vehicles often face long recoveries. Read about pedestrian accidents and bicycle accidents.
Falls on Unsafe Property
Property owners in McDonough, from retailers to apartment managers, have a duty to keep their premises reasonably safe for invited guests. Spills left on the floor, uneven walkways and broken security gates can all lead to serious injuries. Visit our slip and fall and premises liability pages.
Dog Attacks and Wrongful Death
Dog attacks can leave puncture wounds, nerve damage and emotional trauma, and owner responsibility depends on the dog’s history, the circumstances and any leash rules in effect. Learn more on our dog bite lawyer page. If a negligent driver or property owner caused the death of a loved one, Georgia law allows certain family members to pursue a claim; read more about wrongful death cases.
Filing in Henry County, and When the Government Is Involved
A personal injury lawsuit arising in McDonough would typically be filed in Henry County. The Henry County Clerk of Superior Court is located at One Courthouse Square in McDonough. Henry County also has a State Court, which handles many civil damages cases. Depending on who the defendants are and where they reside, venue rules can place a case in another county.
Different rules apply when a government entity is involved, such as a city vehicle, a county truck or a state-maintained road. Claims against the City of McDonough require written ante litem notice within six months (O.C.G.A. § 36-33-5). Claims against Henry County require notice within twelve months (O.C.G.A. § 36-11-1), and so do claims against the State of Georgia, including GDOT (O.C.G.A. § 50-21-26). These deadlines are much shorter than the general filing period.
How Fault and the Two-Year Limit Affect a McDonough Case
Georgia generally allows two years from the date of injury to file a personal injury lawsuit (O.C.G.A. § 9-3-33). Exceptions can apply, but evidence fades quickly, so it is wise to act well before the deadline.
Under Georgia’s modified comparative negligence rule, O.C.G.A. § 51-12-33, your damages are reduced by your percentage of fault, and a finding of 50 percent or more bars recovery entirely. It is common for insurers to dispute fault in interchange and lane-change crashes. If the at-fault driver is uninsured or underinsured, your own UM/UIM coverage under O.C.G.A. § 33-7-11 may provide another source of payment.
