Sandy Springs Truck Accident Lawyer
Sandy Springs and the I-285 Truck Bypass
Sandy Springs sits on the Top End of I-285, the bypass that heavy trucks must use when traveling through Atlanta rather than into it. That puts long-haul tractor-trailers on the city’s main freeway alongside commuters headed to Perimeter Center and the Pill Hill hospitals. Off the interstate, delivery trucks serve the retail and office corridors along Roswell Road and around Perimeter Mall, and construction vehicles are back on GA-400 for a new express lane project. When one of these vehicles hits a car, the result is often far more serious than an ordinary traffic accident.
Hoffspiegel Law represents people injured in truck accidents in Sandy Springs and throughout Fulton County from our office at 2900 Chamblee Tucker Road in Atlanta. Our Fulton County truck accident lawyer page covers truck crashes elsewhere in the county, and our Sandy Springs personal injury lawyer page covers the other kinds of injury cases we handle in the city. For more on truck claims generally, visit our Atlanta truck accident lawyer page. If your crash involved only passenger vehicles, see our Sandy Springs car accident lawyer page.
Truck Corridors Across Sandy Springs
I-285 Exits 22 Through 28
Atlanta has a well-signed ban on through-truck traffic inside the Perimeter on major routes such as I-75, I-85, I-20 and GA-400, and heavy trucks passing through are required to use I-285 instead. In Sandy Springs, I-285 has exits at Northside Drive/Powers Ferry Road (22), Riverside Drive (24), Roswell Road (25), Glenridge Drive (26), GA-400 (27) and Peachtree-Dunwoody Road (28). Trucks are barred from the far-left one or two lanes except where a left exit requires otherwise, so drivers getting to and from those exits must cross lanes shared with tractor-trailers.
GA-400 Truck Limits and Express Lane Construction
GA-400 runs north and south through Sandy Springs. Through trucks are restricted on GA-400 inside the Perimeter, but local deliveries still use the highway and its exits at the Glenridge Connector, Hammond Drive, Abernathy Road and Northridge Road. The North Springs MARTA station ramps (exit 5C) are closed to commercial vehicles entirely. GDOT’s Transform 285/400 project, which began in February 2017, rebuilt the interchange with collector-distributor lanes and flyover ramps. Now heavy construction has moved north: GDOT’s SR 400 Express Lanes project began heavy construction in April 2026 on about 16 miles of GA-400 from the North Springs MARTA station to McFarland Parkway, with the new lanes expected to open in 2031. When a construction vehicle causes a crash, identifying the contractor, subcontractor and vehicle owner is an important early step.
Roswell Road and Perimeter Center Deliveries
Roswell Road and the streets of Perimeter Center, about 60 percent of which lies in Sandy Springs, rely on box trucks and tractor-trailers for deliveries to stores, offices and apartments. Pedestrians walking to and from the Sandy Springs, North Springs and Medical Center MARTA stations share these streets with trucks making wide turns and backing into loading areas.
Trucking Law Issues in a Sandy Springs Crash
Interstate commercial motor carriers must follow the Federal Motor Carrier Safety Regulations, 49 C.F.R. Parts 390–399:
- Part 391 governs who may drive and what records a carrier must keep on each driver.
- Part 395 limits driving and on-duty time and requires carriers to track it.
- Part 396 requires systematic inspection, repair and maintenance.
Evidence that a carrier ignored these rules can establish negligence and show that the company, not only the driver, bears responsibility. Other parties can include the owner of the truck or trailer, the company that loaded the cargo, and a maintenance provider. Georgia law can allow the trucking company’s insurer to be named directly as a defendant (O.C.G.A. § 40-1-112 and § 40-2-140).
If a government truck caused the crash, written ante litem notice is required: within 6 months for a city such as Sandy Springs (O.C.G.A. § 36-33-5), and within 12 months for Fulton County (O.C.G.A. § 36-11-1) or the State of Georgia (O.C.G.A. § 50-21-26).
Records to Demand From the Carrier
In truck cases, the key evidence is in the trucking company’s hands, and some of it is retained only for limited periods. A written preservation demand should request:
- ECM and event data recorder information.
- ELD logs and supporting hours-of-service documents.
- The driver qualification file, including testing records.
- Inspection, maintenance and repair records.
- Dispatch, routing and delivery records.
- Video from cameras on the truck.
Take photos if you are able, including the truck’s company name and USDOT number, and get names and contact information for witnesses.
Sandy Springs Police Reports for Truck Crashes
The Sandy Springs Police Department sells traffic accident reports through its online Police to Citizen (P2C) portal and through its approved partner, Crashdocs.org, as its police reports page explains. Reports are also available in person at SSPD Headquarters, 620 Morgan Falls Road, Monday through Friday, 8:00 a.m. to 5:30 p.m. If the Georgia State Patrol investigated the crash, the Department of Public Safety directs requests to the local State Patrol post or its Open Records Unit.
Fulton County Venue for Truck Lawsuits
Sandy Springs is in Fulton County. The Superior Court of Fulton County is at 136 Pryor Street SW in Atlanta, and the State Court of Fulton County is at the Fulton County Justice Center, 185 Central Avenue SW. A truck accident lawsuit from Sandy Springs may be filed in one of these courts. Trucking companies are often headquartered in other counties or states, and Georgia venue rules may allow or require filing elsewhere, so the forum is analyzed case by case.
Hospital Care and Damages After a Truck Crash
The size and weight of commercial trucks can cause catastrophic injuries: traumatic brain injuries, spinal cord injuries, multiple fractures and internal bleeding. The Pill Hill medical district, near the GA-400 and I-285 interchange, includes Northside Hospital and other hospitals. On the Georgia Department of Public Health’s designated trauma center list, Wellstar North Fulton Hospital in Roswell is a Level II center and Grady Memorial Hospital in Atlanta is a Level I center. Damages can include medical costs, future care, lost income and earning capacity, pain and suffering, and property damage. Families who lost a loved one may have a wrongful death claim. If you were hit on a motorcycle, see our motorcycle accident page.
Fault Rules and Filing Deadlines for Sandy Springs Truck Claims
Georgia’s statute of limitations for most personal injury claims is two years from the crash (O.C.G.A. § 9-3-33), with exceptions that can apply. Under O.C.G.A. § 51-12-33, damages are reduced by the injured person’s percentage of fault, and recovery is barred at 50% or more. Trucking insurers often move quickly after a serious crash, so prompt action protects the evidence.
